Consumer Health Data Privacy Policy

Baby Generation, Inc. conducting business under its tradename Mockingbird (“Mockingbird”, “we”, “us” or “our”) wants our visitors and customers that use and interact with our websites located at www.hellomockingbird.com and help.hellomockingbird.com (the “Sites”) and utilize our customer service features available through text messages, interactive features (such as chatbots) that are available on the Sites, email, mail and/or phone (“Customer Support”) to know how we collect, use, disclose and protect information about you, including information that may be considered consumer health data (“health data”) as defined by some state laws.  By interacting with us through our Sites and our Customer Support services, and purchasing goods from our Sites (the “Products”) you consent to the use of health data that is collected or submitted as described in this Consumer Health Data Privacy Policy (“Health Policy”).  The Sites, Customer Support and the Products are collectively referred to as the “Services”.  As required by law, we will obtain additional consent for collecting, using, disclosing or selling your health data.  For more information on how Mockingbird handles information about you, please see our Privacy Policy.

This Policy does not apply to any sites, products, applications, platforms, or other services not directly linking to this Policy. Please read this Policy carefully to understand our policies and practices regarding your consumer health data and how we will treat it. If you do not agree with our policies and practices, you should not use the sites, products, applications, platforms, or other services linking to this Policy.

We may update this Health Policy, so we encourage you to review it periodically.

Types of Health Data We May Collect About You

Depending on how you interact with the Services, we may collect and use different types of health data from and about you, including:

  • Medical information, should you provide us with your due date, your trimester information, or information that you are pregnant;
  • Information related to an injury if you bring a claim against Mockingbird;
  • Information that could identify your attempt to acquire or receive products that may reveal health information; and
  • Any inferences of the above derived, extrapolated, or inferred from non-health information.

Uses and Purposes of Collecting Health Data:

  • Fulfilling orders, assisting in returns, facilitating our relationship with you when you request information or enroll in our Parent Host program.
  • Providing Customer Support or providing the Products or information that you request from us and responding to your questions or requests for information.
  • Facilitating performance, security, and integrity of the Services, including fraud prevention and obtaining performance analytics.
  • Complying with our legal obligations.
  • Communications and marketing.
  • Improvement of our Services.

As required by law, we will obtain consent for additional purposes for collecting and using your heath data.  You may still receive marketing that includes health-related content, e.g., content related to items purchased by pregnant individuals, as our Products are geared towards people that are welcoming a baby into their life, and such advertisements may be unrelated to your individual health data.

Health Data Sources

We may collect consumer health data from the following sources:

  • You, including when you provide information to us through Customer Support, set up an appointment to talk to us, apply to be a Parent Host and/or provide information when you purchase Products.
  • Your device when you visit or interact with our Services, including through cookies, web beacons, and similar technologies that automatically send us information when you browse, use, visit, or otherwise interact with our Services.
  • Our business and marketing partners, who provide us with information about consumers who are viewing our content across other websites, purchasing our Products, or interacting with our promotions, benefits, or programs.
  • Publicly available sources.

Consumer Health Data Disclosures

We do not sell your health data for monetary value.

We may disclose any of the consumer health data listed above to processors, service providers, and contractors that help us provide Services to you. We may also disclose your health data to other third parties, including business partners, advertising networks, regulatory authorities, professional advisors, and business transfer related companies.  We may disclose your health data to other third parties at your direction or with your specific consent.

We instruct these processors, service providers, contractors, and third parties to only use health data as permitted by our contracts with them and consistent with applicable law.

Your Privacy Rights

If you are a Washington or Nevada resident, you have specific rights with respect to your health data, such as the right to access or delete such data.  If you or your authorized agent want to exercise these rights, please submit a request using the contact information below.  

If you previously provided consent and would like to withdraw that consent, please contact us using the contact information below.

In responding to a request, Mockingbird will need to determine if we have such information about you and we may ask you to verify your request.  If we are able to locate information about you, and verify your request, we will fulfill your access or deletion request.  We may ask for additional information or relevant certificates if you are an authorized agent submitting a request on someone else's behalf.  Please note that your request may be limited in some instances, such as, when complying with a request would impair our ability to comply with legal requirements.
